Terms of Service - AutomatePost SEO Blog Platform

1. Introduction and Acceptance

Welcome to AutomatePost, an AI-powered content generation platform operated by Emcee IT Solutions LLC ("Company", "we", "us", or "our"), the company behind AutomatePost. These Terms of Service ("Terms") govern your use of our website, services, and AI content generation tools (collectively, the "Service").

By accessing or using AutomatePost, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Service Description

AutomatePost provides AI-powered content generation services including:

Blog Research: AI-driven SEO research and keyword analysis
Blog Posting: Complete blog post creation with WordPress publishing

Our services integrate with WordPress for seamless content publishing and management.

3. Account Registration and Responsibilities

To use our Service, you must create an account and provide accurate, complete information. You are responsible for:

All activities that occur under your account
Ensuring your account information remains current and accurate
Immediately notifying us of any unauthorized use of your account

You must be at least 18 years old or have parental consent to use our Service.

4. Credit System and Pricing

AutomatePost offers a free starting tier, monthly and annual credit-based subscriptions, and one-time Lifetime BYOK plans. Current prices, credit allowances, and included features are shown on the Pricing page for the selected plan and billing period.

Free tier: Start with 100 free credits, with no credit card required. These are starting credits, not an ongoing credit allowance included with Lifetime BYOK.
Monthly subscriptions: Billed monthly in advance and auto-renew monthly unless cancelled.
Annual subscriptions: Billed annually in advance at the annual price shown on the Pricing page, which advertises 17% savings compared with monthly billing.
Lifetime BYOK: A one-time payment for ongoing platform access within your website limit, with OpenAI API usage paid separately. Section 12 explains the applicable limits and conditions.

Credit costs vary by tool and complexity. Additional credit packages may be purchased. Credits do not expire but are non-transferable and non-refundable.

You may cancel or change a monthly or annual subscription at any time, but no refunds will be provided for unused credits or partial billing periods. After a successful Lifetime BYOK upgrade, the same account cannot return to a monthly or annual credit-based plan. Lifetime BYOK is a one-time purchase and does not have recurring AutomatePost subscription fees.

5. Acceptable Use Policy

You agree not to use our Service to:

Generate content that is illegal, harmful, abusive, or discriminatory
Create misleading, false, or defamatory content
Violate intellectual property rights of third parties
Generate spam, malware, or phishing content
Attempt to reverse engineer or compromise our AI systems
Share account credentials or attempt to circumvent usage limits

We reserve the right to suspend or terminate accounts that violate this policy.

6. Intellectual Property Rights

Your Content: You retain ownership of content you create using our Service. However, you grant us a limited license to process your input data to provide our services.

Generated Content: AI-generated content created through our Service is owned by you, subject to these Terms. You are responsible for ensuring generated content does not infringe third-party rights.

Our Platform: The AutomatePost platform, including our AI models, algorithms, and proprietary technology, is owned by us and protected by intellectual property laws.

7. Third-Party Integrations and Services

Our Service integrates with third-party platforms for publishing (currently WordPress) and also relies on third-party analytics, marketing, and customer-support providers to operate and improve the Service. These may include Google Analytics (traffic and product analytics), Meta Pixel (advertising performance and conversion measurement), and ChatNest (in-app chat and support). Each of these services operates under its own terms and privacy policies. We are not responsible for:

Third-party platform availability or functionality
Data loss or corruption during integration processes
Changes to third-party APIs, cookies, or terms of service
Content that violates third-party platform policies

AI detector scores are estimates only and may vary based on the generated content, the detection tool used, changes to third-party detection systems, and other factors. AutomatePost does not guarantee any specific AI-detector score or that generated content will be classified as human-written by any AI detection service.

10. Termination

Either party may terminate this agreement at any time. You may cancel your account through your account settings. We may terminate or suspend your account if:

You violate these Terms or our Acceptable Use Policy
Your account remains inactive for extended periods
We discontinue the Service (with reasonable notice)
Required by law or legal process

Upon termination, your access to the Service will cease, and we may delete your account data after a reasonable retention period.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Lifetime BYOK Plan - Bring Your Own Key (BYOK)

Lifetime BYOK plans are one-time purchases that provide ongoing access to AutomatePost tools under a Bring Your Own Key ("BYOK") model. There are three Lifetime BYOK plans based on website limits for connected websites in AutomatePost:

$99 for 1 website
$199 for up to 3 websites
$299 for up to 5 websites

By upgrading to or purchasing a Lifetime BYOK plan, you acknowledge and agree that:

Website limit: Your Lifetime BYOK plan includes access for the number of connected websites stated for that plan (1, 3, or 5). This means a website connected under My Websites for generation and publishing. You cannot add unlimited websites beyond your plan. Using AutomatePost for more websites than your plan allows requires purchasing a higher Lifetime BYOK plan, where offered.
No AutomatePost AI usage fees: AutomatePost does not charge ongoing AI usage fees on a Lifetime BYOK plan. The one-time purchase covers access to AutomatePost for the websites included in your plan. You still pay OpenAI separately for API usage through your own OpenAI account.
No platform credits: AutomatePost does not provide ongoing generation credits as part of a Lifetime BYOK plan. Any remaining promotional or previously purchased credits are used first; once they are exhausted (or insufficient for a request), further generation requires your own OpenAI API key.
Generation depends on OpenAI: Content generation on a Lifetime BYOK plan is not unlimited free usage from AutomatePost. Availability and volume depend on your OpenAI API account status, including OpenAI billing, usage, rate limits, outages, and other OpenAI account restrictions. AutomatePost is not liable for OpenAI fees, rate limits, outages, or account actions taken by OpenAI.
Your API key: You must obtain and maintain a valid OpenAI API key at your own expense to generate content. You are solely responsible for creating, securing, rotating, and revoking that key.
Key storage and use: If you save an OpenAI API key in AutomatePost, it is stored with your AutomatePost account and encoded before storage. The key is used only to process your generation requests. If your OpenAI API key stops working, you may update or replace it at any time from your AutomatePost plan settings. You may also remove your key from those settings.
No downgrade: After a successful upgrade to a Lifetime BYOK plan, you cannot downgrade to a monthly or annual credit-based plan.
Future features: Lifetime BYOK users receive future features compatible with the BYOK model at no additional AutomatePost cost and without another AutomatePost subscription. Certain features that are not compatible with that model may be offered only to monthly paying customers. OpenAI API usage costs still apply when using your own key.
Compliance: Your use of OpenAI through BYOK remains subject to OpenAI’s terms and policies, in addition to these Terms.

If you do not agree to these BYOK terms, do not purchase or upgrade to a Lifetime BYOK plan.
